Father Arrested After Teen Daughter Gives Birth in Walmart Bathroom, Baby Found Dead

A tragic incident unfolded in a Texas Walmart, leading to the arrest of a 45-year-old man after his daughter allegedly gave birth to a baby in the store’s bathroom. The baby was later found dead in a trash can, and the father has been charged with endangering a child.

The Disturbing Discovery

On Monday evening, around 10:30 p.m., Walmart employees in Kingsville were shocked to find a newborn baby in the bathroom trash can. The employees immediately began lifesaving efforts before the baby was rushed to a local hospital.

Despite the efforts, the baby was sadly pronounced dead by doctors. Police were called to the scene shortly after.

Surveillance Footage Leads to Arrest

Officers reviewed the store’s surveillance video and saw a 17-year-old girl enter the bathroom alone. About 40 minutes later, she was seen leaving the bathroom and walking out to her car in the parking lot. It was about half an hour later that employees discovered the baby.

At approximately 11 p.m., police located the teen’s vehicle and pulled her over. Paramedics transported the girl to the hospital, where she is receiving medical care.

The police later arrested her father, Jerry Lee Martinez, on charges of abandoning or endangering a child with criminal negligence. He is currently in the Kleberg County Jail without bond.

Investigation and Ongoing Details

While the cause of the baby’s death is still unclear, investigators have not yet confirmed whether the baby was alive at birth. Police have stated that more information will be released as the investigation progresses. The teen’s father faces serious charges, and authorities plan to interview the girl once she is discharged from the hospital.

The tragic situation has raised concerns about the safety of newborns and the emotional toll on those involved. Kingsville, located near Corpus Christi, remains in shock over the event.

Texas Safe Haven Law

Texas law offers a potential alternative to such tragic outcomes through its Baby Moses Law (Safe Haven Law), which allows parents to safely and legally abandon newborns less than 60 days old at designated locations, such as hospitals, without facing criminal charges.

This law aims to prevent unsafe situations like the one that led to the baby’s death.

This heartbreaking case highlights the importance of both education and support systems for young people facing difficult situations. As the investigation continues, many are left to reflect on how tragic events like this might be prevented in the future.

Police have expressed their condolences and are continuing their inquiry into the circumstances surrounding the baby’s death.
