Hawaii traffic Rule 2025 Update: Understanding the Right Turn on Red Rule

As motorists, we’ve all encountered the situation where you reach an intersection and the traffic light isn’t functioning. Whether it’s due to a power outage or a storm, this can create confusion on the road.

The County of Hawai‘i Department of Public Works Traffic Division provides helpful guidance on how to navigate these situations and stay safe.

Let’s review the rules of the road when traffic signals malfunction and what to do when making right turns at red lights.

Malfunctioning Traffic Signals – Who Has the Right of Way?

When a traffic signal is not functioning or is flashing, it’s essential to treat the intersection like a four-way stop. Here’s how to handle it:

  • Yield to Traffic: Yield to motorists who reach the intersection before you. This ensures that traffic flows in a safe and orderly manner.
  • If Vehicles Arrive Simultaneously: If two vehicles arrive at the same time, the vehicle on the right has the right of way. This rule applies to avoid confusion and prevent accidents.
  • Proceed with Caution: Always proceed cautiously through the intersection. Remember that other vehicles, pedestrians, and bicyclists might not stop, so be extra aware of your surroundings.

If you encounter a non-functioning traffic signal, it’s important to report it so it can be fixed. During regular business hours (Monday to Friday, 7:00 a.m. to 3:30 p.m.), call the Traffic Division at (808) 961-8341. For after-hours reports, contact the Hawai‘i Police Department at 9-1-1.

Red Light: To Turn or Not to Turn?

In Hawai‘i, right turns on red are generally allowed, but there are a few key points to remember:

  • Complete Stop First: When making a right turn on red, you must come to a full stop before proceeding. Only continue when it’s safe to do so.
  • Right Turn on Red with Red Arrow: Even if there is a red arrow for a right turn, you are still allowed to make the turn unless there is a sign that specifically prohibits it.

However, be especially cautious when making right turns on red, as pedestrians may be legally crossing the street during the “WALK” or flashing red “DON’T WALK” signals. It’s always best to make eye contact with pedestrians before turning to ensure they have cleared the intersection safely.

Pedestrian Safety

Pedestrians are an essential part of road safety. If you’re turning right at a red light, be mindful of pedestrians crossing the street. Even if you have the green light or a green arrow, remember that pedestrians have the legal right of way when crossing at the designated signals.

Ensure their safety by waiting for them to clear the crossing, and always proceed cautiously.
